Term & Conditions for DB FPX

The Customer must provide full briefings to DB FPX and verify that all information supplied about the Order is correct.DB FPX will work closely with the Customer and use reasonable care and skill to ensure that the Order is completed successfully, as one would expect from a reputable research firm. The Customer will help DB FPX achieve this by providing all necessary information at the outset of the transaction and collaborating with DB FPX throughout the transaction if further information or instruction is needed.

The Customer understands that failure to give such information or guidance during the transaction may create a delay in the delivery of their Work and that DB FPX will not be held liable for any loss or harm resulting from such a delay. The ‘Completion on Time Promise’ will not apply in such instances.

Approvals and Authority

If DB FPX needs to confirm a specific detail, they will contact the Customer using the email address or phone number supplied by the Customer.

The Customer recognizes that DB FPX may accept instructions sent through various means of communication and may reasonably believe that such instructions came from the Customer.

Payment

The Customer agrees to pay DB FPX the agreed-upon fee for the services rendered.

Payment is due upon receipt of the invoice and must be made in accordance with the payment terms specified.

DB FPX reserves the right to withhold delivery of the Work until payment has been received in full.

Confidentiality

DB FPX will treat all information provided by the Customer as confidential and will not disclose it to third parties without the Customer’s consent, except as required by law.

The Customer agrees to keep all information related to the Work confidential and not to disclose it to third parties without DB FPX’s consent.

Intellectual Property

All intellectual property rights in the Work produced by DB FPX remain the property of DB FPX until full payment has been received.

Upon receipt of full payment, the Customer will have the right to use the Work for its intended purpose.

Limitation of Liability

DB FPX’s liability to the Customer is limited to the amount paid by the Customer for the specific Work in question.

DB FPX will not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the services provided.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which DB FPX is incorporated.

Amendments

DB FPX reserves the right to amend these terms and conditions at any time. Any amendments will be posted on the DB FPX website and will be effective immediately upon posting.
